A Nos.3717, 3718 and 3720 of 2023 in C.S No.764 of 2013 A.A.NAKKIRAN, J.

These three applications have been filed by the applicant/plaintiff, i) to condone the delay of 60 days in filing the application to set aside the abatement caused due to the death of 1st defendant in the above suit, ii) to set aside the abatement caused due to the death of 1st defendant and iii) to bring on record the legal heirs of the 1st defendant viz., respondents 9 to 11 herein and array them as defendants in the above suit.

2. Heard both sides.

3.Being satisfied with the reasons stated in the affidavits filed in support of these applications, these three applications are allowed.

4. Learned counsel for the applicant/plaintiff is directed to carry out necessary amendment and issue notice to the newly impleaded defendants. 5.Post the matter on 11.08.2023.
