The petitioner who was arrested and remanded to judicial custody on 22.06.2022 for the offences punishable under Sections 366(A) of IPC read with Section 5(l)& 6 of POCSO Act, 2012 in Crime No. 244 of 2022 on the file of the respondent police, seek bail.

2. The case of the prosecution is that the defacto complainant's daughter was found missing from 09.06.2022. It was later found that, she was kidnapped and raped by the petitioner herein. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. That apart, the petitioner was arrested and remanded to judicial custody on 22.06.2022. Hence, he sought for bail to the petitioner.

4. The learned Government Advocate (Crl.Side) had submitted that already this Court dismissed the petitioner's bail petition in Crl.O.P.No.18859 of 2022 dated 10.08.2022. Hence, he vehemently opposed to grant bail to the petitioner.

Taking into consideration of the above facts and circumstances of the case, since the petitioner has committed very serious and heinous offence as against the victim girl, that apart, this is the second bail petition and there is no change in circumstances and hence this Court is not inclined to grant bail to the petitioner.
