The petitioner who was arrested and remanded to judicial custody on 23.03.2022 for the offences punishable under Sections 8 (C ) r/w 20(b)(ii)(c ), 29 (1) and 25 of NDPS Act, in Crime No. 15 of 2022 on the file of the respondent police seeks bail.

2. The case of the prosecution is that when the respondent police was on regular petrol, they found that the petitioner along with other accused was found to be in possession of 200 Kgs of dry Ganja which comes underr commercial quantity. Hence the case.

3. Heard both sides.

4. Considering the facts and circumstances of the case and also taking note of the quantity of the contraband which comes under commercial quantity and also there is no change of circumstance after dismissing the previous bail earlier bail petition. Hence, this court is not inclined to grant bail to the petitioner. Further, this Court has already directed the II Additional District Judge/Special Judge for EC/NDPS Act, Salem to dispose the case within a period of four months but till date it is not disposed. However, this court is inclined to give further three months time to complete the Trial Court.
