A.No.3724 of 2022 in C.S.No.74 of 2020 Krishnan Ramasamy, J., This application has been filed seeking for amendment of the cause title in 2nd defendant name as M/s. Loyal Housing Development (P) Ltd. instead of M/s. Loyal Housing (P) Ltd.

2. Learned counsel for the applicant would submit that in the name of 2nd defendant, the word 'Development' was inadvertently omitted and the same was brought to the attention by 2nd defendant who filed an affidavit to reject the plaint. He would further submit that due to the mistake in the name, in the order passed by this Court for attachment of property also, a direction was given to the Company which is not existing. Therefore, he would submit that the omission of the word 'Development' is not wilful and deliberate but bonafide and hence, the present application is filed seeking for amendment.

3. This Court is satisfied with the reasons stated in the affidavit filed in support of the Application and the submission of the learned counsel for the applicant. Accordingly, this Application stands allowed as prayed for. https://www.mhc.tn.gov.in/judis

4. The applicant/plaintiff is directed to carry out necessary amendments within a period of two weeks from the date of receipt of a copy of this order and serve a copy of the amended plaint to the respondents within a period of one week thereafter.
