This petition has been filed for a direction to the Court below to dispose of the application filed under Section 156(3) of Cr.P.C. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

3.It is seen from records that the application was returned by the Court below on 05.07.2023 for complying with some defects pointed out. The learned counsel for the petitioner submitted that the application is yet to be re-presented before the Court below.

4.It is left open to the petitioner to comply with the defects pointed out by the Court below and thereafter, re-present the application and on such re-presentation, 2/4
