ORDER

This Writ Petition has been filed for the issuance of Writ of Mandamus, to direct the second respondent to consider the representation dated 03.06.2019 and dispose the same within time stipulated by this Hon'ble Court.

2.There is no representation for the petitioner. Heard Mr.V.Jeevagiridharan, learned Additional Government Pleader appearing for the respondents 1 and 2.

3.The petitioner submitted a representation on 03.06.2019 to cancel the patta issued in favour of the third respondent and issue patta in favour of the petitioner in respect of the land comprised in Old Survey No.189/1, T.S.No.84, 85, 86, 87, 88 and 89 to an extent of 40 cents, situated at Block No.37, Virugambakkam Village. On receipt of the representation, the second respondent directed the Sub Inspector of Survey to inspect the field.

4.On inspection, the Sub Inspector of Survey, reported that the subject property stands registered in the Revenue Records in the name of the third respondent. Further, the said lands are being utilized as a playground by the children of the said area. Neither the petitioner nor the third respondent is in possession and enjoyment of the said property. That apart, though the second respondent issued notice to the petitioner as well as the third respondent, no one appeared for the enquiry. 5.In view of the above, the petitioner is not entitled for the relief sought for in this writ petition and the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. Consequently, connected Miscellaneous petition is closed. There shall be no order as to costs.
