..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents 1 and 2 to survey and demarcate and fix the boundaries of the petitioners land in Survey No.233/1 measuring an extent of 6.50 acres Survey No.258/45D measuring an extent of 1.50 acres, survey No.258/46D measuring an extent of 1.50 acres, survey No.258/47D measuring an extent of 2.50 acres, survey No.258/50C measuring an extent of 1.50 acres, survey No.258/1D measuring an extent of 2.50 acres and Survey No.234/2B measuring an extent of 3.24 acres situated at Soolaimen Village, Uthukottai Taluk, Tiruvallur, District based on the online application submitted by the petitioner dated 01.04.2024 and consequently

direct the 3rd Respondent to provide adequate police protection to the Revenue Officials for conducting the survey and demarcation proceedings and complete the same.

ORDER

This Writ Petition has been filed to direct the respondents to consider the petitioner's online application dated 01.04.2024.

Learned counsel for the petitioner would submit that the petitioner has made an online application dated 01.04.2024 to survey and demarcate and fix the boundaries of his land in Survey No.233/1 measuring an extent of 6.50 acres Survey No.258/45D measuring an extent of 1.50 acres, survey No.258/46D measuring an extent of 1.50 acres, survey No.258/47D measuring an extent of 2.50 acres, survey No.258/50C measuring an extent of 1.50 acres, survey No.258/1D measuring an extent of 2.50 acres and Survey No.234/2B measuring an extent of 3.24 acres situated at Soolaimen Village, Uthukottai Taluk, Tiruvallur, District and consequently direct the 3rd Respondent to provide adequate police protection to the Revenue Officials for conducting the survey and demarcation proceedings and complete the same. However, the same was not considered, as on date. Hence, this writ petition.

3. Ms.Inthu Karunakaran, learned Government's Counsel accepts notice on behalf of the respondents 1 & 2 and submitted that the petitioner's application dated 01.04.2024 will be considered within a period of eight weeks.

4. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondents 1 & 2 to consider the petitioner's online application dated 01.04.2024 and carry out a survey and complete the process, after giving prior notice to the petitioner and other aggrieved parties, if any, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is open to the respondents 1 & 2 to request for police protection before the third respondent/jurisdictional police. If any such request is made, the third respondent/jurisdictional police is directed to provide an adequate police protection for conducting the survey.

6. It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent to conduct a survey and lay boundary stones at the subject land. In the event any dispute arises regarding the

possession of the subject property, the same has to be decided by way of filing a suit before the competent Civil Court.

7. With the above direction, this writ petition stands disposed of. No costs.
