ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the second respondent to issue patta in favour of petitioner in respect of land comprised in Natham S.No.258/21, Old S.No.258/1, measuring an extent of 10 cents, situated at Kazhiyappanallur Village, Tharangambadi Taluk, Mayiladuthurai District, within a time frame to be fixed by this Court by considering the petitioner's representation dated 28.03.2025. 3.It is submitted by the learned counsel for the petitioner that petitioner purchased the above mentioned property from the legal heirs of deceased Narasimma Nadar vide Sale Deed dated 20.07.2009, registered as Document No.784 of 2009 before the Sub Registrar, Tharangambadi. 4.It is further submitted that petitioner submitted a representation dated 2/6

28.03.2025 before the second respondent seeking issuance of patta, the second respondent after the receipt of the representation had directed the third respondent to conduct an enquiry and submit report within 15 days. However, the same has not been considered by the respondents till date. Aggrieved by the same, the petitioner has come before this Court. 5.At the outset, it is submitted by the learned Special Government Pleader appearing for respondents that the second respondent directed the Tahsildar to conduct an enquiry and to submit a report. The said enquiry is under progress and on receipt of such report, appropriate orders would be passed within a time frame fixed by this Court, which was agreed to by the learned counsel for petitioner.

6.In view thereof, the writ petition is disposed of with a direction to the second respondent to consider the report to be submitted by the Tahsildar within 4 weeks from the date of receipt of copy of this order and pass appropriate order in accordance with law, after affording an opportunity of hearing to the petitioner and any other interested parties/rival claimants, if any, within a period of 8 weeks from the date of receipt of Tahsildar report. The above exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this 3/6

order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
