..Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 1st respondent to change the classification of the land and delete the entries in Kali Natham (Vacant land) in respect of the land in Sub division number No.596/7 and the Subdivision number No.596/11 and 596/12 were classified as santhu (lane) at 1/5

The petitioner herein seeks a direction to respondents to change the classification of the land in Survey Nos. 596/7, 596/11 and 596/12.

According to the petitioner, the father of the petitioner purchased the properties situated in the above mentioned Survey No's under two sale deeds of the year 1967 and 1970 registered as Document Nos.1143 of 1967 and 934 of 1970 and after his death, the petitioner and his siblings have been in possession and enjoyment of the 8.75 cents of land situated in the above mentioned Survey No's.

3. It is the case of the petitioner that Survey No.596/7 was wrongly classified as unoccupied Natham land. The land in Survey Nos.596/11 and 596/12 were wrongly classified as lane portion. Aggrieved by the same, the petitioner submitted a representation to the respondents on 22.02.2024 and the same has not been considered. Hence, the writ petition.

4. Mr.A.Selvendran, learned Special Government Pleader for the respondents submitted that re-classification was made long back and the petitioner has not made any objection at the relevant point of time.

In view of the assertion made by the petitioner that his father purchased the above mentioned properties under registered documents and he has been in possession and enjoyment of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to 1st respondent to consider the representation of the petitioner dated 22.02.2024 and pass appropriate orders on merits within a period of eight weeks from the date of receipt of copy of this order. 3/5
