Respondents Prayer : The writ petition is filed to issue a Writ of Mandamus, directing the first respondent to pass orders on the request of the petitioner submitted with reference to cancellation of patta issued in the name of the fourth respondent and transfer of patta in the name of the petitioner in respect of the agricultural lands measuring to an extent of acres 2.09 cents comprised in Survey No.363/3, Silavattam Village, Madurantakam Taluk, Kancheepuram District.

Heard.

2. This writ petition has been filed, praying that this Court may be pleased to issue a Writ of Mandamus, directing the first respondent to pass orders, based on the representation of https://hcservices.ecourts.gov.in/hcservices/

the petitioner, with reference to the cancellation of patta, issued in the name of the fourth respondent and to transfer the same in the name of the petitioner, in respect of the agricultural lands, having an extent of 2.09 acres, comprised in Survey No.363/3, situated at Silvattam Village, Madurantakam Taluk, Kancheepuram District.

3. At this stage of the hearing of the writ petition, the learned counsels, appearing on behalf of the respondents had submitted that the fourth respondent has preferred a civil suit, in O.S.No.80 of 2012, on the file of the District Munsif Court, Madurantakam, and the said suit is pending disposal.

4. The petitioner is the second defendant in the said suit. The suit had been filed by the fourth respondent herein, praying for the declaration of his title and for the consequential relief of permanent injunction.

5. In such circumstances, this Court is not inclined to direct the respondents 1 to 3 herein, to decide the issue relating to the transfer of patta, in the name of the petitioner. Hence, the writ petition stands dismissed. No costs.
