Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition that he has to report before Judicial Magistrate Court No. 1, Erode daily at 10.30 A.M. until further orders imposed by this Honble Court Crl.O.P.No. 14644 of 2018 order dated 19.06.2018 on the file of this Honble Court.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.J.FRANKLIN, Advocate for the petitioner and of MR. M.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent and of MR.K.V.MUTHU VISAKAN, Advocate for the intervener the court made the following order:- Petition for relaxation of the bail condition imposed in Crl.O.P.No.14644 of 2018 dated 19.06.2018.
2. This court, while granting bail to the petitioner, imposed a condition that the petitioner shall stay at Erode and appear before the learned Judicial Magistrate-I, Erode daily at 10.30.a.m. until further orders. The present petition has been filed for modification of the said condition.
3. The learned counsel for the intervenor would submit that even after the grant of anticipatory bail, the petitioner has been continuing to threaten the defacto complainant and thereby, he would pray that the petition for relaxation may be dismissed.
4. The learned Additional Public Prosecutor submitted that the petitioner has been complying with the condition regularly.
5. Taking into consideration the submission made by the learned Additional Public Prosecutor, the condition imposed on the petitioner https://hcservices.ecourts.gov.in/hcservices/
in Crl.O.P.No.14644 of 2018 dated 19.06.2018 is modified to the effect that the petitioner is directed to appear before the learned Judicial Magistrate-I, Erode on the first working day of every mont at 10.30.a.m until further orders.
