...Defendant Prayer: Plaint has been filed under Order IV Rule 1 of Original Side Rules read with Order VII Rule I of Civil Procedure Code, 1908 and Section 7 of the Commercial Courts, Act 2015, to grant a judgement and decree on the following terms:-

a) For recovery of a sum of Rs.4,93,18,575 (Rupees Four Crores Ninety Three Lakhs Eighteen Thousand Five Hundred and Seventy Five Only) together with interest at 24% per annum on 3,52,00,000/- (Rupees Three Crores and Fifty Two Lakhs Only) from the date of plaint till the date of realization;

b) To direct the Defendant to pay costs of the Suit to the Plaintiff; c) For such further or other reliefs as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice. For Plaintiff : M/s.Menon, Karthik, Mukundan & Neelakantan For Defendant : M/s.Kuman Paul Chopra J U D G E M E N T The plaintiff and the defendant have entered into a compromise which has been reduced into writing in a Memorandum of Settlement dated 09.08.2023. The Memorandum of Settlement is signed by the plaintiff and the defendant and also by their respective counsels. The said Memorandum of Settlement dated 09.08.2023 is taken on file.

2. Accordingly this Civil Suit is decreed in terms of the Memorandum of Settlement dated 09.08.2023. The terms contained in Clause Nos.1 to 6 of the Memorandum of Settlement signed by the plaintiff and the defendant shall form part of the decree. Consequently, connected application is closed. No Costs.
