Respondents Prayer: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondents to extend the benefits of G.O.Ms.No.856, Public works Department dated 01.06.1977 by notionally promoting the petitioner to the post of Road Inspector Grade-I with effect from 28.01.1978, and consequently promote the petitioner to the post of Road Inspector selection Grade with effect from 28.01.1988 promote the petitioner to the post of Road Inspector Special Grade with effect from 28.01.1998 confer Road Inspector Super Grade from 28.01.2003 and correspondingly revise his pay and other benefits including the pensionary benefits in the light of the order

passed by this court in W.P.No.7738 of 2008 and batch of cases dated 12.12.2012 in accordance with law.

ORDER

Mr.V.P.R.Elamparithi, learned Government Advocate takes notice on behalf of the first to fourth respondents and Mr.V.Vijay Shankar, learned counsel takes notice on behalf of the fifth respondent.

2. This writ petition is disposed at the time of admission by directing the first and second respondents to pass appropriate orders on the representation dated 05.03.2021 of the petitioner within a period of sixteen weeks from the date of receipt of a copy of this order in accordance with law and on merits.

3. While disposing the representation of the petitioner, the first and second respondents shall consider whether the petitioner is indeed entitled to benefit of G.O.Ms.No.856, Public Works Department dated 01.06.1977 in the light of the order of this Court in W.P.(MD).Nos.7738 to 7749 of 2008 vide order dated 12.12.2012. No costs. Consequently, connected Writ Miscellaneous Petition is closed.
