Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, forbearing the 3rd respondent to dig the canal in the petitioner's Agricultural land comprised in Survey No.50/2 measuring to an extent of 0.60.00 area situated at Pennagaram Dharmapuri District, as illegal, arbitrary, contrary to law in view of the petitioner's representation dated 14.07.2023. ORDER

The petitioner expressed her apprehension that the second respondent is proposing to dig up a channel through her property in Sy.No.50/2 of Pennagaram Village.

2.Mr.A.Anandan, learned Government Advocate takes notice for the respondents 1 and 3.

3.Ms.E.Ranganayaki, learned counsel takes notice for the second respondent and made a statement on the instructions of the second respondent, Mrs.S.Geetha, Executive Officer, Pennagaram, who is present before the Court to assist the Court, that there is no proposal to dig up any channel in the land of the petitioner and that it is being done to drain excess water from a water body through the property of another party who has given consent to drain the same through his property. 2/4

4.The said statement of the learned counsel for the second respondent is recorded.

5.In view of the above, nothing survives for consideration in this Writ Petition and accordingly, it is closed. No costs. Consequently, the connected miscellaneous petition is closed.
