The Tahsildar Taluk Office Krishnagiri Krishnagiri District Respondent Prayer: Writ petition filed under Article 226 of the Constitution of India seeking issuance of a writ of certiorarified mandamus calling for the records relating to the order of online rejection dated 16.7.2016 on the application of the petitioner dated 4.7.2016 on the file of the respondent, quash the same and direct the respondent to issue Panniandi S.C. Community Certificate to the petitioner within the time to be stipulated by this Honourable court.

ORDER

(Order of the court was made by M.JAICHANDREN, J.) Heard the learned counsel appearing for the petitioner, as well as the learned counsel appearing on behalf of the respondent.

2. This writ petition has been filed praying that this court may be pleased to issue a Writ of Certiorarified Mandamus calling for the records relating to the order of online rejection dated 16.7.2016, rejecting the application of the https://hcservices.ecourts.gov.in/hcservices/

petitioner, dated 4.7.2016, on the file of the respondent, quash the same and to direct the respondent to issue Panniandi S.C. Community Certificate to the petitioner, within the time limit to be stipulated by this Honourable court.

3. The petitioner has stated, inter alia, that the application made by the petitioner, on 4.7.2016, online, for the issuance of the community certificate stating that the petitioner belongs to Panniandi Scheduled Caste Community, had been rejected, on 16.7.2016. The reasons for the rejection has been shown as 'invalid data'. In the remarks column, it has been stated as 'Revenue Inspector's enquiry report not enclosed'.

4. Learned Special Government Pleader appearing for the respondent had submitted, on instructions, that the impugned order, dated 16.7.2016, may be set aside and the respondent may be directed to pass fresh orders considering the application of the petitioner, dated 4.7.2016, for the issuance of the community certificate, as prayed for by the petitioner.

5. In view of the submission made by the learned Special Government Pleader, the online rejection order, dated 16.7.2016, passed by the respondent is set aside. The respondent is directed to consider the application of the petitioner dated 4.7.2016, for the issuance of the community certificate, as prayed for by the petitioner and to pass an appropriate order thereon, after giving an opportunity of hearing to the petitioner, within a period of three weeks from the date of receipt of copy of this order. The writ petition is ordered accordingly. No costs. The connected miscellaneous petition is closed.
