Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the order issued by the third respondent in Proc No.TP 1/33511/2018, dated 08.02.2019 and to quash the same in respect of this petitioner alone and issue consequential directions to the third respondent to consider the claim of the petitioner for retransfer from Nagapattinam to Ambattur in the light of his representations dated 10.06.2021 and 27.07.2021 and in light of the circular in Letter (Ms) No.92/S/09 dated 22.07.2009 regarding transfer of physically challenged person.

O R D E R

This writ petition has been filed seeking to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order issued by the 3rd respondent in Proceedings No.TP 1/33511/2018, dated 08.02.2019 and to quash the same in respect of this petitioner alone and to issue consequential directions to the 3rd respondent to consider the claim of the petitioner for re-transfer from Nagapattinam to Ambattur in the light of his representations dated 10.06.2021 and 27.07.2021 and in light of the circular in Letter (Ms)No.92/S/09 dated 22.07.2009 regarding transfer of physically challenged person.

2. At the time of admission, there is no interim order granted by this Court. Now, the petitioner has challenged the impugned transfer order dated 08.02.2019. After lapse of three years, this Court is not inclined to interfere with the said impugned transfer order. Apart from that, the impugned order passed by the 3rd respondent based on the guidelines issued by the Government of India in Letter (Ms) No.92/S/2009, dated 22.07.2009.

3.Accepting the said reasons stated in the counter affidavit filed by the 3rd respondent, there is no merit in the present writ petition.

4.Accordingly, the writ petition stands dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
