The petitioner, who apprehends arrest for the alleged offence under Sections 379, 430 IPC r/w Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No.161 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were alleged to have illegally transported 2 units of lake sand in a JCB and tractor.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that there are three previous cases pending as against the petitioner and he is an history sheeter. Anu opposed to grant anticipatory bail to the petitioner. .

5. Considering the previous cases pending as against the petitioner, this Court finds that the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
