2. The above C.M.P. has been filed to amend the prayer in the plaint and this Court, allowed the aforesaid C.M.P. on 09.09.2024. However, before signing the order it is noticed that the matter requires some clarification. Hence, the matter is listed today under the caption 'for clarification'.

3. The suit has been filed for specific performance and the suit was also decreed in favour of the plaintiff/petitioner herein. Today, the learned counsel for the petitioner would state that he restricts his claim with regard to 1st respondent/1st defendant alone.

4. Considering the factual aspects of the matter, we are of the view that the 1st respondent has to be heard. Therefore, the 1st respondent/1st defendant is directed to be present before this Court on 26.09.2024. Post the matter on 26.09.2024.
