(Order of the Court was made by Dr.Anita Sumanth J.) Mr.C.R.Malarvannan, learned Counsel for Government of Tamil Nadu (Criminal Side) accepts notice for the respondents and is fully armed with instructions to enable this Court to take up the matter for final disposal. Hence, by consent of both learned counsel, final orders are passed in this Writ Petition.
2. The plea of the petitioner for ordinary leave of 21 days has been rejected on the ground that the convict one Karthik, S/o.Sugumar, confined in Central Prison - I, Puzhal had not completed the mandatory period of one year as required under the provisions of the Tamil Nadu Suspension of Sentence Rules, 1982.
3. Learned counsel for the petitioner points out that this was true, as at the time of filing of the representation or even at the time of consideration thereof, the convict has not completed the period of one year. However, as on the date of passing of the impugned order dated 05.06.2026, the convict has completed the mandatory period of one year.
4. In these circumstances, we direct the authorities to re-look into the representation in light of the changed circumstances now. Let orders be passed afresh, within a period of two (2) weeks from today, in accordance with the extant Regulations.
5. This Writ Petition is disposed as above. Connected Miscellaneous Petition is closed.
