The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 341, 323, 324 and 506(ii) of IPC in Crime No.446 of 2022 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that on 12.08.2022 at 8.00 a.m., when the defacto complainant's brothers were at home, the 2nd accused came in a car in rash and negligent manner and hit the dog and the same was died on the spot. It was questioned by the defacto complainant's brother, due to which, the petitioners along with others scolded the defacto complainant's brothers in filthy language, assaulted them with deadly weapons, threatened them with dire consequences and also caused injuries to them. Hence, the complaint.

3. The learned counsel for the petitioners would submit that the 1/3

petitioners are innocent persons and they have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. Therefore, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) would submit that all the accused persons attacked the injured on his right leg, due to which, his right leg was amputated.. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Taking into consideration the facts and submissions of the learned Counsel and also the fact that there is a specific overt act against the petitioner, the custodial interrogation for the petitioner is very much required in this case. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 2/3
