Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, to direct the respondents 2 to 5 to recover a sum of Rs.3,46,950/- towards gratuity along with simple interest @ 10% per annum from 04.05.2016 till 03.11.2018 and a compound interest of 15% from 04.11.2018 till the date of payment of the Gratuity from the 1st respondent as stipulated in Certificate of Recovery dated 01.03.2019 r/w order dated 20.09.2018 in G.A.No.134 of 2018 issued by the Controlling Authority cum Labour Officer. O R D E R
It is represented by the learned counsel appearing for the petitioner as well as the respondents that the issue involved in this writ petition is considered and decided in batch of cases in W.P.Nos.9485/2019 etc. dated 13.11.2019, wherein this Court, while disposing those writ petitions directed the respondents therein to formulate a scheme for the settlement of the gratuity dues as per the orders of the Controlling Authority under the Payment of Gratuity Act, 1972 and settle the amount as expeditiously as possible within a period of six months from the date of receipt of a copy of the said order. Therefore, they submitted that the same order can be passed in this matter also.
2. In view of the above stated facts and circumstances and by following the earlier order passed by this Court in the above said cases, this Writ Petition is disposed of by directing the respondents to formulate a scheme for settlement of the gratuity dues as per the orders of the Controlling Authority under the Payment of Gratuity Act, 1972 and settle the amount as expeditiously as possible, in any event, within a period of six months from the date of receipt of a copy of this order. No costs.
