This Criminal Original Petition has been filed to direct the respondent to delete the Section 185 M.V. Act in FIR No.133 of 2021 dated 25.08.2021 on the file of the respondent against the petitioner.
2. The petitioner is an accused in Crime No.133 of 2021 and he has committed an accident on 24.08.2021 and got injured. The respondent has registered the case punishable for the offence under Sections 279, 337 of IPC and 185 of M.V.Act. Since the petitioner was under the influence of alcohol, the accident has taken place. While pending investigation, the petitioner has filed this petition directing the respondent to delete the Section 185 of M.V. Act in Crime No.133 of 2021.
3. In view of the above facts and circumstances, since the petitioner is an accused in Crime No.133 of 2021, in order to
co-opearte for investigation, the petitioner shall appear before the respondent and explain the incident. Therefore, the prayer sought for by the petitioner to delete the Section 185 MV Act in FIR.No.133 of 2021 dated 25.08.2021 stands dismissed.
