O R D E R

This petition has been filed to transfer the investigation in Cr.No.323 of 2018 from the file of the Inspector of Police, Singanallur to some other Investigating Officer.

2. On the complaint lodged by the petitioner, the respondent police have registered a case in Cr.No.323 of 2018 on 05.04.2018 under Sections 341, 324 and 506(ii) IPC against one Kannan and others. While so, the petitioner has filed the present petition for transfer of investigation.

3. On a reading of the FIR, it is seen that the petitioner is a widow and has two sons, one of whom is Chitti Babu; on 04.04.2018 around 11.45 p.m., she was informed by one Karthikeyan that her son Chitti Babu is lying with injuries near Wall Green Apartments; when she went there, she saw her son Chitti Babu with injuries and when questioned, he told her that he has been attacked by one Kannan and his gang. Hence, the FIR.

4. Mr.Deivasigamani, learned counsel for the petitioner submitted that the police have not acted swiftly after registration of the FIR and had not taken any steps to https://hcservices.ecourts.gov.in/hcservices/

apprehend the accused and arrest them immediately. Therefore, the petitioner is seeking transfer of investigation.

In the opinion of this Court, just because the police have not arrested the accused involved in offences under Sections 341, 324 and 506(ii) IPC, it cannot be concluded that the investigation is not going in the right lines. Hence, this is not a fit case to transfer the investigation to any other agency. However, this Court directs the Deputy Superintendent of Police, in charge of Singanallur Police Station to monitor the investigation in Cr.No.323 of 2018 that is being conducted by the Inspector of Police, Singanallur Police Station and complete the same expeditiously. With the above direction, this petition stands disposed of.
