ORDER : The Court Made the following order :- The Criminal Original petition is filed seeking, to pass an order enlarging the petitioner on bail in Crime No.98 of 2018 pending investigation on the file of the respondent.

The learned Government Advocate submitted that the petitioner has been falsely implicated in this case and an Alteration Report has been filed in the original case for the offence under Section 5(I), 6 of POCSO Act and Section 366(A) of IPC and he is in judicial custody for the past 75 days, since he was arrested on 15.05.2018. Further, he submitted that the Alteration Report has been filed with age certificate, Medical Certificate and Medical Examination for the sexual offence and also the 164 Statement given by the victim girl before the Judicial Magistrate, Palacode. https://hcservices.ecourts.gov.in/hcservices/

After, going through the entire records, there is no mitigating circumstances to grant the bail considering the nature gravity of the offence and specific overt act. Hence, this Court is not inclined to grant bail. Accordingly, this Criminal Original Petition is dismissed.
