Writ Petition filed under Article 226 of the Constitution of India to issue the Writ of Mandamus, forbearing the first respondent from selling the second respondent plant to the Private Management for not complying the G.O.Ms.No.656 dated 29.06.1978.

ORDER

The petitioner was one of the persons who had given his land to the Government for the formation of Steel Plant at Salem, on the promise that those persons would be given employment in the said Steel Plant. Identification cards for the displaced families in Salem Steel Plant was also issued by the Special Deputy Tahsildar (LA), on 23.04.1977 and the Tahsildar Omalur Taluk, Salem District, has also issued identification cards to such persons on 29.06.1978 and a Government Order in G.O.Ms.No.656, dated 29.06.1798 was issued by the Government. https://hcservices.ecourts.gov.in/hcservices/

It is a grievance of the petitioner that though 212 persons were given employment, some persons including the petitioner were not given the employment and the representation dated 10.07.2018 submitted in that regard also failed to invoke any account of response. Hence, the petitioner came forward to file present writ petition.

3. Heard the learned counsel appearing for both the parties and perused the documents.

4. This Court, taking into consideration the above facts and circumstances and also on perusing the typed set of papers filed in support of this writ petition, is of the view that if at all, the petitioner has any right to priority in the employment, that is the responsibility to the District Collector who has to consider the eligibility of the petitioner herein and fit him for appropriate job, whenever there is vacancy in the priority under displaced persons category. Assurance given by the Government at the time of acquiring the lands for establishing Steel Plant cannot give any right to the petitioner to stop the policy decision of the Government and it is to be worked out independently.

5. With the above observation this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
