O R D E R

The relief sought for in the present writ petition is to direct the respondents to settle and dispose of the retirement and pensionary benefits due to the petitioner on the death of her husband, S.Thandapani, formerly Accountant (Selection Grade), Sub-Treasury, Tindivanam in the light of the representation made by the petitioner dated 02/01/2019, within a limited time frame as deem fit by this Honourable Court.

2. The grievance of the writ petitioner is that the pensionary benefits due to her, on account of the death of her husband, are yet to be settled in entirety. The learned Senior Counsel appearing on behalf of the petitioner made a submission that some of the benefits have already been granted to the writ petitioner and some more benefits are yet to be settled including the family pension and other benefits.

3. The husband of the writ petitioner was facing a criminal case 2/4

and during the pendency of the criminal case, he died. Thus, the proceedings got abated and consequently, the petitioner is now entitled to all the benefits due to her husband

4. The learned Special Government Pleader appearing on behalf of the respondents made a submission that the petitioner is receiving the family pension regularly. However, the respondents are bound to settle all other balance benefits due to her in accordance with the rules. In this regard, the respondents are directed to initiate steps to settle all the benefits due to the petitioner along with the interests as per the rules, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition stands disposed of. There shall be no order as to costs.
