ORDER

The petitioner apprehends arrest for the alleged offence under Sections 326(g), 324(4) of Bharatiya Nyaya Sanhita and Section 4 of Prevention of Damage to Public Property Act, 1984 and Section 3 of the Explosive Substances Act, 1908 in Crime No.163 of 2026 on the file of the respondent

police seeks anticipatory bail.

2. The case of the prosecution is that the de facto complainant is the supervisor of the TASMAC shop situated at Salem Korimedu Jallikattu. On 07.06.2026 at about 1.15 A.M, the de facto complainant received a call from the building tenant that, two unknown persons came in a two wheeler with two petrol filled bottles and threw the same on the closed shop due to which the refrigerator placed inside the gate was damaged, subsequently they fled. Hence, the case.

The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the de facto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the accused persons have hurled petrol bomb and caused fire to Tasmac Shop, due to which a refrigerator worth Rs.33,000/- was damaged. Hence, he opposed to grant anticipatory bail to the petitioners.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. Considering the facts and circumstances of the case, taking note of the submissions made by the learned counsel on both sides, considering the totality of the circumstances, and the serious allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
