O R D E R

This criminal original petition has been filed to cancel or modify the condition of depositing Rs.1,50,000/- imposed in the order dated 03.10.2013 in Crl.M.P.No.1025 of 2016 on the file of the Principal Sessions Judge, Erode.

2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the State.

3. The petitioners got anticipatory bail in Crl.MP.1025 of 2016 on 03.10.2016 by the Principal Sessions Judge, Erode on condition that they should deposit a sum of Rs.1,50,000/- each, with the Court of Chief Judicial Magistrate, Erode, aggrieved by which, the petitioners are before this Court for modification of the aforesaid condition.

4. Learned counsel appearing for the petitioners submitted that the petitioners were employees under the 1st accused and https://hcservices.ecourts.gov.in/hcservices/

they did not enjoy the fruits of the business that were granted by the 1st accused and therefore, the sum of Rs.1,50,000/- imposed by the Principal Sessions Judge, is indeed very onerous.

5. This Court gave its anxious consideration to the rival submissions.

6. Taking into consideration the facts and circumstances of the case, this Court modifies the impugned condition to the effect that the petitioners shall deposit a sum of Rs.1 lakh each instead of Rs.1,50,000/-. Rest of the conditions imposed by the Principal Sessions Court shall remain the same. Time to surrender is extended till 07.11.2016.
