A.No. 4651 of 2022 IN C.S.No. 215 of 2021 C.V.KARTHIKEYAN, J.

This Application has been filed seeking to condone the delay of 327 days in filing the written statement. By an earlier order in A.No. 4553 of 2022, the learned Master had condoned the delay in representing the written statement and that order was passed on 14.10.2022.

2. In the affidavit filed in support of the present Application, it had been stated that instructions had to be given to the counsel particularly since there was defect in the cause title owing to the third plaintiff having died on 07.05.2021 and legal representatives had to be impleaded.

Since it is a suit for partition and it would only appropriate that pleadings are considered by the Court, this Application is allowed and the delay is condoned and the written statement is taken on record.
