Respondents Application under Order XIV, Rule 8 of Original Side Rules read with Section 9(e) of Arbitration and Conciliation Act, 1996, has been filed seeking seeking interim injunction restraining the first respondent from convening the AGM on 24.07.2024 at 6.30 pm at 9/23, North Madha Church Street, Royapuram, Chennai-13 or at any such other adjourned date, until disposal of the arbitral proceedings to be initiated. ORDER

This application has been filed for interim injunction restraining the first respondent from convening the Annual General Body Meeting (AGM) on 24.07.2024 at 6.30 pm at 9/23, North Madha Church Street, Royapuram, Chennai-13.

On perusal of the additional counter affidavit-II filed by the first respondent, it is revealed that notice dated 02.07.2024 20.07.2024 was issued to the members of first respondent association intimating the date for convening Annual General Body Meeting (AGM) for the years 20222023 and 2023-2024. The agenda for the said meeting was also issued to the members of the first respondent association on 17.06.2023. Accordingly, Annual General Body Meeting was conducted on 24.07.2024 and to substantiate the same, learned counsel for the first respondent produced a copy of the notice, agenda and the minutes of the meeting.

3. This Court, by its order dated 24.07.2024, granted interim injunction. However, even before communicating the order granting interim injunction, the first respondent conducted Annual General Body Meeting on 24.07.2024 itself. Therefore, nothing survives for further adjudication in this matter and accordingly, this application stands dismissed.
