O R D E R

The petitioner, who was arrested and remanded to judicial custody on 26.11.2024, for the offence punishable under Section 8(C), Section 20(b)(ii)(C) of Narcotic Drugs & Psychotropic Substances Act, in Crime No.712 of 2024, registered on the file of the respondent, seeks bail.

2. On specific information, the respondent police went to Kasipuram B-Block 5th Street and arrested this petitioner, who was found in possession of 3 kgs of ganja. On further investigation, the room in which the petitioner was staying was searched, and from that room 18 kgs of ganja was seized. On further information given by this petitioner, the other two accused were arrested, through whom the petitioner used to sell ganja procured from Orissa.

3. Learned counsel appearing for the petitioner submitted that this petitioner has been in prison for nearly 9 months and is ready to comply with any condition imposed by this Court for granting bail.

4. Learned Government Advocate (Crl. Side) appearing for the 2/4

respondent police submitted that the petitioner was found in possession of a total of 21 kgs of ganja, which is a commercial quantity. He hails from Andaman and Nicobar Islands, has the habit of procuring ganja from Orissa and transporting it to other places, and his associates, A2 and A3, are in custody.

5. As far as this petitioner is concerned, he is having one previous case of a similar nature, and if he is released on bail, he may indulge in some offences.

6. This Court, on taking into consideration that the petitioner is involved in trafficking a narcotic drug of commercial quantity and that his antecedents do not inspire confidence that he will not indulge in offences in future, finds that the pre-condition imposed under Section 37 of the NDPS Act is not satisfied in this case. Hence, this Criminal Original Petition stands dismissed.
