PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, pleased to call for records of the impugned proceedings issued in Na.Ka.Aa.01/04/2022, dated 16.08.2022 passed by the second respondent and quash the same and consequently, directing the respondents 3 & 4 to grant protection for the peaceful conduct of Kumbabishekam festival on 28.08.2022 and 29.08.2022 at Oomaikaliiyampal Temple, East Street, Veerananallur Village, Kattumannarkoil Taluk, Cuddalore District.

O R D E R

The Writ Petition has been filed to quash the order passed by the Tahsildar in Na.Ka.Aa.01/04/2022 dated 16.08.2022 stating that as if there is group in the village in conducting the temple festival.

2. Learned counsel for the petitioner would submit that there is no fraction in the village and only on behalf of the village, the function is being organized. Hence, he seeks to quash the proceedings in Na.Ka.Aa.01/04/2022 dated 16.08.2022 and grant permission to conduct the temple festival.

3. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents 1 to 4.

4. In such view of the matter, the petitioner is directed to give an undertaking before the concerned police. On such undertaking, the police shall consider the representation given by the petitioner and grant permission by considering over all circumstances.

5. With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petitions are closed. No costs. 25.08.2022 Index :Yes/No Internet:Yes/No shk/nr
