O R D E R

The petitioner, who was arrested and remanded to judicial custody on 30.05.2025, for the offence punishable under Sections 132, 109 of BNS and 1/4

Section 3(1) of TNPPDL Act, in connection with Crime No.212 of 2024, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that on 27.09.2024, based on the secret information, the respondent police intercepted the lorry bearing registration No.RJ 11 GC 6845 and found that the petitioner along with other accused persons had committed robbery in ATM at Thrissur, Kerala. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, he is suffering incarceration from 30.05.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 4.The learned Government Advocate (Crl. Side) appearing for the respondent police, while opposing for grant of bail to the petitioner submitted that there are totally seven accused in this case and the petitioner/A2, who is a native of Hariyana, along with other accused committed robbery in ATM at Thrissur, 2/4

Kerala and stolen huge sums of money. They have also used a car to transport the stolen money to lorry. Based on the secret information, the respondent police placed barricades to intercept the vehicle but the accused persons hit the barricades thereby causing injuries to the police officers. Subsequently, the accused persons were caught by the respondent police hence, he strongly opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, submissions made by the learned counsels on either side, considering the gravity of the offence committed by the petitioner and huge sums of money involved in this robbery case, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed. 01.07.2025 rsi 3/4
