This Original Petition has been filed under Section 372 of the Indian Succession Act XXXIX, 1925 read with Order XXV Rule 6 of the Madras High Court Original Side Rules, to grant succession certificate in favour of the petitioner with power to collect the debts and to receive interest thereon in respect of the debts mentioned in the schedule. 2.The petitioner is the son of Late Palamadai Muthuswamy Ramachandran. According to the petitioner, his father had two children viz., the petitioner herein and another son who predeceased his father. His mother died on 07.07.2020 and his father died on 06.05.2021. His father left the deposits in HDFC Securities bearing Trading Account No.2402438 to the tune of Rs.4,33,660/- and therefore, he seeks succession certificate to collect the debts and to receive interest thereon in respect of the debts mentioned in the schedule.

3.The petitioner has examined himself as P.W.1 and marked 7 1/3

documents as Exs-P.1 to P.7. The document viz., Ex-P.1 is the photocopy of the Aadhaar card of the petitioner; Ex-P.2 is the photocopy of the petitioner's passport; death certificates of his parents are marked as Exs-P3 and P4. Ex-P.5 is filed to show the funds lying in HDFC Securities. The legal heirship certificate of his father is marked as Ex-P.6. 4.Considering the averments made in the petition and the documents filed by the petitioner and as no other claim is made, this Court is of the view that the petitioner is entitled to succession certificate. 5.Accordingly, this Original Petition is ordered as prayed for and a direction for grant of Succession Certificate in favour of the petitioner with power to collect the debts and to receive interest thereon in respect of the debts mentioned in the schedule, is issued.
