The petitioner, who was arrested and remanded to judicial custody on 17.04.2024 for the alleged offence punishable under Sections 341, 294(b), 392, 397, 506(ii) of IPC, in Crime No.98 of 2024, on the file of the respondent Police, seeks bail.
2. Learned Counsel for the petitioner submitted that this is the second bail petition filed by the petitioner. He further submitted that the petitioner is an innocent person has been falsely implicated in this case, whereas he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is in custody from 17.04.2024, and he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.
3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner had waylaid the defacto complainant abused him in filthy language and robbed a sum of Rs.3,000/- from him at knife point. He further submitted that the petitioner is a history sheeter and having 22 previous cases pending against him. However, he vehemently opposed for the grant of bail to the petitioner. 4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
5. Considering the facts and circumstances of the case, and also considering the submissions made by the learned counsel on either side and taking note of the fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
