PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to set aside the order passed by the learned Special Judge under TNPID Act, Chennai in Crl MP No.800 of 2019 dated 26.06.2019 and grant complete relaxation to sign before the respondent police. O R D E R

This petition has been filed challenging the order passed by the Court below dismissing the application filed by the petitioner to relax the condition imposed on the petitioner directing the petitioner to appear once in 15 days before the Investigation Officer, till the charge sheet is filed. 2.

The Court below had dismissed the petition on the ground that the petitioner did not properly comply with the condition and therefore, the said condition cannot be relaxed.

The learned Additional Public Prosecutor on instructions submitted that the petitioner stopped appearing before the Investigating Officer after 22.05.2019 and thereafter, he had appeared only once on 29.06.2019.

Taking into consideration the facts and circumstances of the case and also of the fact that the case involves 7,000 depositors being defrauded by not repaying back their deposits, this Court is not inclined to interfere with the order passed by the Court below. comply with the condition imposed by the Court failing which, his relaxation petition cannot be considered. 5.

This Criminal original petition is dismissed and the petitioner is directed to appear before the Investigating Officer once in 15 days and comply with the conditions strictly, for a period of three months and thereafter, seek for modification / relaxation.
