CR.NO.899 OF 2019 Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition, to deposit a sum of Rs.2,00,000/- instead of Rs.3,00,000/- which were mentioned in the Hon`ble High Court, Madras by order dated 27.02.2020 in Crl.O.P.No.4466/2020.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. SARAVANAN P., Advocate for the petitioner and of L.CHARLES PREMKUMAR GOVERNMENT ADVOCATE (CRL SIDE) on behalf of the Respondents the court made the following order:- The petitioner has been granted anticipatory bail Vide order of this Court dated 27.02.2020 in Crl.OP.No.4466 of 2020, on certain conditions. One of the condition imposed on the petitioner, in paragraph No.4(b) is that he should deposit a sum of Rs.3,00,000/- to the credit of Crime No.899 of 2019, before the concerned Magistrate within a period of four weeks from the date on which the order copy made ready.

2. The present petition is filed seeking modification of the said condition on the ground that the petitioner has underwent surgical procedure, owing to which, he could not mobilise the entire amount. The learned counsel for the petitioner submits that he could now deposit Rs.2,00,000/- instead of Rs.3,00,000/- as indicated in the above order.

3. Heard Mr.L.Charles Premkumar, learned Government Advocate (Criminal Side) and he did not offer any objection. https://hcservices.ecourts.gov.in/hcservices/

4.Considering the submission of the learned counsel for the petitioner and that no objection was raised by the learned Government (Advocate) Criminal Side, this petition is allowed and the petitioner is now directed to deposit Rs.2,00,000/- (Rupees Two Lakhs only) to the credit of Crime No.899 of 2019, before the concerned Magistrate within a period of four weeks from today. -sd/- 04/02/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
