ORDER

This Transfer Civil Miscellaneous petition has been filed to withdraw the H.M.O.P.No.43 of 2022 pending on the file of Subordinate Judge, Vedasandur and transfer the same to Family Court, Chennai. 1/4

2. I have heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondent and I have also gone through the documents filed in support of their submissions.

3. The learned counsel for the respondent/husband submits that he has no objection to transfer the H.M.O.P.No.43 of 2022 filed by the petitioner/wife to the learned Subordinate Judge, Vedasandur as prayed for.

4. It is settled law that in the matters concerning matrimonial disputes, convenience of wife shall be given preference. In the case on hand petitioner/wife and respondent filed petition for divorce by mutual consent before Sub Court, Vedasandur. It is stated by wife subsequently she shifted her residence to Chennai and she finds it very difficult to under take long travel to Vedasandur at Dindigul District which is 450 kms away.

5. Recording the submission made by the learned counsel appearing for the respondent/husband and also by taking into consideration the convenience 2/4

of wife, the transfer petition is allowed by withdrawing HMOP.No.43 of 2022 pending on the file of the Subordinate Judge, Vedasandur and transferred the same to the file of Family Court, Chennai. No Costs. Consequently, connected Miscellaneous Petition is closed.
