This petition has been filed seeking to condone the delay of 295 days in filing the appeal.

2.Heard the learned counsel for the petitioners.

3. Mr.E.Kannadasan, learned counsel takes notice for the 1st respondent and Mrs.Harini, learned counsel takes notice for the 2nd respondent. The learned counsel for the 2nd respondent does not have serious objections in allowing the petition.

4. The 1st petitioner would aver that due to financial crisis, the delay of 295 days occurred.

5. Accepting the averments made in the affidavit filed in support of this petition, this Court is inclined to allow this Civil Miscellaneous Petition and the delay of 295 days is condoned on condition to waive the interest for the delay period.
