This Criminal Original Petition has been filed to call for the entire records in connection with F.I.R in Crime No.13 of 2024, pending on the file of the first respondent-Police and quash the same.
2. Heard the learned counsel appearing for the petitioners, the learned counsel for the second respondent and the learned Government Advocate (Crl.Side) appearing for the first respondent-Police and perused the materials available on record.
3. Learned counsel for the petitioners submitted that the petitioners are in-laws of the second respondent/de-facto complainant. Based on the second respondent's complaint, the first respondent-Police registered a case in Crime No.13 of 2024 as against the petitioners and
their son. Since the second respondent/complainant is an influential person in politics, the first respondent-Police are harassing the petitioners under the guise of enquiry. The petitioners are no way connected with the alleged offences and a false case has been lodged as against the petitioners.
4. The learned counsel for the de-facto complainant /second respondent submitted that the accused persons harassed the second respondent and also demanded dowry.
5. On a perusal of the records, it is seen that prima facie allegations are available as against the petitioners. It is for the Investigating Officer to conduct investigation and file a charge sheet. The grounds raised by the petitioners are nothing but defence and the same can be agitated during the course of trial and not in this petition by invoking Section 528 of the BNSS. The petitioners are directed to cooperate for the completion of investigation. The first respondentPolice is directed to expedite the investigation and file a final report as
early as possible. While conducting investigation, the respondent-Police is directed to adhere to the procedure of the BNSS and not to adopt the third hand method.
6. With the abovesaid directions, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 14.07.2025 mfa Index:Yes/No Speaking Order: Yes/No To
