C.M.P.Nos.16847 & 16860 of 2019 in A.S.S.R.Nos.63892 & 63890 of 1989 S.M.SUBRAMANIAM, J.

The petitions on hand are filed under Order XXXIII Rule 1 C.P.C. and r/w Section 151 of C.P.C. to permit the petitioners to file an appeal as Indigent Persons.

2.The learned counsel appearing on behalf of the petitioner made a submission that the petitioners are earning meager amount which would not even be sufficient to meet out their livelihood. In this regard, the report is called for and the learned Special Government Pleader received the report from the Revenue Divisional Officer, Ponneri in Rc.No.3529/2019 A3 dated 29.10.2019, wherein it is stated that all the petitioners are residing in "Tsunami Houses". In view of the fact that the petitioners are not in a position to pay Court fee in the First Appeal and considering the Indigent Person report submitted by the Revenue Divisional Officer, this Court is inclined to consider the petition and accordingly, the petitioners are permitted to file the Appeal as Indigent Persons as prayed for.
