This case came up for settlement before the Lok Adalat. Both the parties are present. Mr.P.D.Audikesavalu, learned counsel for the respondents 1 to 4 is present.

TERMS OF SETTLEMENT The writ petition in W.P.No.42554 of 2006 pending on the file of the High Court, Madras has been referred to the Lok Adalat for conciliation today.

2. The petitioner has filed this writ petition to issue a writ of mandamus or direction in the nature of a writ, directing the respondents to dispose the petitioner's representation dated 13.09.2006 and pass such further or other orders as the Hon'ble Court may deem fit and proper in the circumstances of the case.

3. The petitioner and the respondents 1 to 4 filed a joint memo to the effect that the representation of the petitioner has been considered by the respondents and a sum of Rs.26,17,000/- was received by the respondents from the petitioner on 16.11.2007. It is also stated in the memo that the respondent has also closed the accounts of the petitioner on receipt of the above said amount and documents received for creating equitable mortgage has also been returned by the authority concerned to the petitioner on 09.11.2009. The said Joint Memo has been recorded by the Lok Adalat.

4. In view of the compromise arrived at between both parties before the Lok Adalat and in view of the recording to the above said Memo containing the details of payment by the petitioner to the respondents, it is ordered that there is no amount due to the respondents from the petitioner. Award is passed to the effect that nothing survive in this writ petition. Writ Petition is disposed of accordingly. The aforesaid memo shall form part of the award. No order as to costs. Signature of the counsel for petitioner is not necessary since the said counsel has already signed along with petitioner in the Memo filed and recorded.

The full Court fee paid shall be refunded to the petitioner in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
