COMMON ORDER These writ petitions have been filed to direct the respondent-Transport Corporation to pay the petitioners interest at the rate of 12% per annum on the belated payment of their Provident Fund (PF), Gratuity and Earned leave.
2. The learned counsel for the petitioners would submit that the petitioners were employed as Drivers and Conductors in the respondentTransport Corporation. After attaining the age of superannuation, the petitioners were retired from their service respectively. However, their retirement benefits were paid belatedly without paying any interest. It is the submission of the petitioners that they are entitled for the interest for the belated payment. In this regard, they have submitted representations dated 03.01.2025, 21.02.2025 and 26.02.2025 respectively to the respondent-Transport Corporation.
3. The learned Standing Counsel appearing on behalf of the respondentTransport Corporation would fairly concede that in view of the similar orders passed by this Court in W.P.Nos.40031, 33742 and 35806 of 2024, they are Page No.3 of 6
willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4. In view of the above submission, this Court deems it appropriate to direct the respondent to pay the interest at the rate of 6% per annum from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioners, within a period of six (6) weeks from the date of receipt of a copy of this order.
5. With the above directions, these Writ Petitions stand disposed of. No costs.
