ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.06.2026 for the alleged offences under Sections 80 and 85 of the Bharatiya Nyaya Sanhita, 2023 r/w Section 4 of the Dowry Prohibition Act, in Crime No.164 of 2026 on the file of the respondent police, seeks bail. 1/4

2. It is the case of the prosecution that the petitioner demanded dowry from the family of the deceased, who is his wife. On account of such dowry harassment, the deceased is alleged to have committed suicide. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner has no role to play in the suicide committed by the deceased and has been falsely implicated in this case. He would further submit that the petitioner has been in custody since 05.06.2026 and is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing the grant of bail to the petitioner, reiterated the prosecution case and, on instructions, submitted that the investigation is at a preliminary stage and the postmortem report is yet to be received. He would further submit that, if the petitioner is enlarged on bail, there is every possibility of his tampering with witnesses.

5. Considering the totality of the circumstances, the submissions made by the learned Government Advocate (Crl. Side), the fact that the investigation is at 2/4

a preliminary stage, and having regard to the nature and gravity of the allegations, this Court is of the view that it would not be appropriate to grant bail to the petitioner at this stage.

6. Accordingly, the Criminal Original Petition is dismissed. 22.06.2026 skr Note:
