Respondents Prayer: This Writ petition has been filed under Article 226 of the Constitution of India to issue a writ of declaration that the entire recruitment process for the post of Diesel Loco Driver in Chennai Port Trust pursuant to the second respondent's proceedings made in No. CME/EA1/365/2008/Estt. Dated 26.05.2008 as null and void and the same is tainted with capriciousness, arbitrariness coupled with extraneous consideration and consequently direct respondents 1 & 2 to conduct fresh recruitment for the said post of Diesel Loco Driver in a transparent manner by selecting qualified and meritorious candidates strictly adhering to the statutory regulations. Dated 26.05.2008 as null and void and the same is tainted with capriciousness, arbitrariness coupled with extraneous consideration and consequently direct respondents 1 & 2 to conduct fresh recruitment for the said post of Diesel Loco Driver in a transparent manner by selecting qualified and meritorious candidates strictly adhering to the statutory regulations.

2. The learned counsel for the respondent would contend that another W.P.No. 13864 of 2008 was filed by another employee for the same cause of action and it was allowed in favour of the employees and the selection which was made earlier was set aside and fresh selection was made. 3.The learned counsel for the second respondent would further submit that the entire proceedings has been completed and nothing survives for adjudication. Hence in view of the same , this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
