Respondent Prayer: Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to modify the condition imposed in Crl.M.P.No.11730 of 2019 dated 28.06.2019 directed the petitioner to deposit a sum of Rs.5,000/- (Rupees Five Thousand only) to credit of the Crime No.207/2019 before the said Court and the final order in respect of the amount will be passed at the end of the Criminal Proceeding by the trial Court and the petitioner shall report before the respondent police daily at 10.30 a.m., for period of one month.

O R D E R

This petition has been filed seeking for a modification of the condition imposed by the Court below while granting anticipatory bail to the petitioner in Crl.M.P.No.11730 of 2019 dated 28.06.2019.

2.The petitioner apprehended arrest by the respondent police in the course of investigation in Crime No.207 of 2019. He filed a petition seeking anticipatory bail. The Court below on consideration of the facts and circumstances of this case, was pleased to grant anticipatory bail by imposing certain conditions.

3.The petitioner is aggrieved by the condition imposed by the Court below wherein the petitioner has been directed to deposit a sum of Rs.5,000/-.

4.The learned counsel for the petitioner submitted that the petitioner is very poor and he is not in a position to deposit the said amount. The learned counsel further submitted that the facts of the case does not warrant imposing a condition for cash deposit.

5.Heard the learned Additional Public Prosecution appearing for the respondent police.

6.Taking into consideration, the facts and circumstances of this case, the condition imposed by the Court below directing the petitioner to deposit a sum of Rs.5,000/- is hereby set aside. The other conditions imposed by the Court below shall stand as it is.

7.This Criminal Original Petition is disposed of with the above direction.
