This Criminal Miscellaneous Petition has been filed to modify the condition imposed on the petitioner vide order dated 08.07.2024, in Crl.M.P.No.5364 of 2022 in Crl.R.C.No.529 of 2022.

2. The learned counsel appearing for the petitioner submits that this Court vide order dated 08.07.2024, directed the petitioner to deposit 50% of the cheque amount to the credit of C.C.No.2575 of 2013 on the file of the learned Metropolitan Magistrate, Fast Track Court No.II, Egmore, Allikulam, Chennai within a period of two weeks from the date of receipt of a copy of the order, however, the petitioner is unable to mobilize the amount and this Court directed the co-accused/A2 to deposit a sum of Rs.50,000/- only before the trial Court and both the accused Nos.2 and 3 faced trial on the same C.C.No.2575 of 2013 and the petitioner is ready to deposit a sum of Rs.50,000/- before the trial Court. https://www.mhc.tn.gov.in/judis

3. Heard the learned counsel appearing for the petitioner.

4. Considering the facts and circumstances of the case, the condition imposed on the petitioner vide order dated 08.07.2024, in Crl.M.P.No.5364 of 2022 in Crl.R.C.No.529 of 2022 is modified to the effect that the petitioner shall deposit 40% of the cheque amount to the credit of C.C.No.2575 of 2013 on the file of the learned Metropolitan Magistrate, Fast Track Court No.II, Egmore, Allikulam, Chennai within a period of two weeks from the date of receipt of a copy of this order, failing which, the order of interim stay granted shall stand automatically vacated, without any further reference to this Court. 09.08.2024 ssb CRL.M.P.No.11284 of 2024 in Crl.R.C.No.529 of 2022 https://www.mhc.tn.gov.in/judis
