(Order of the Court was made by R.SUBRAMANIAN, J.) Admittedly the suit for partition filed by the appellant has since been dismissed.

The appellant seek an order of injunction restraining the respondents from alienating the property subject matter of the suit. Section 52 of the Transfer of Property Act protects the interest of the appellant inasmuch as it makes all alienations made pending lis subject to the result of the lis.

2. Hence we do not see any case for grant of injunction, the petition is dismissed. It is made clear that any alienation made will be subject to the result of the suit.
