This Criminal Original Petition has been filed to direct the respondent not to harass the petitioner under the guise of enquiry.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
3.Today, Mr.R.Senthil Kumar attached to R-5 Virugambakkam Police Station is present before this Court. On instructions, learned Additional Public Prosecutor submitted that there is no complaint or petition pending as against the petitioner before the respondent Police. However, the petitioner's son by name Shahul Hameed is a tenant under one Kalpana and that, the said Kalpana has given a complaint against Shahul Hameed, for enquiring into which, the Police had called the petitioner. 4.In such view of the matter, the petitioner is directed to cooperate with the police for enquiry and at the time of https://hcservices.ecourts.gov.in/hcservices/
conducting enquiry, the petitioner shall not be harassed. During the course of enquiry, if any cognizable offence is made out, the respondent police is free to register an FIR and this order shall not be a shield for the petitioner against arrest.
