This Transfer Civil Miscellaneous petition is filed by the petitioner/husband in the matrimonial proceedings seeking transfer of F.C.O.P.No.216 of 2016, pending on the file of Family Court, Vellore to the file of Family Court, Chennai.

2. F.C.O.P.No.216 of 2016 was filed by the respondent/wife under Section 10(vii) and (x) of the Indian Divorce Act for dissolving the marriage solemnized between the petitioner and respondent on 27.08.2015 on the ground of cruelty. The marriage was solemnized as per Christian Marriage Rites and Customs and the O.P. was filed under the Indian Divorce Act, before the Family Court, Vellore.

3. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

4. It is stated in the affidavit filed in support of the petition that the respondent/wife is not residing in Vellore and she is employed in Bangalore. Though the Transfer Civil Miscellaneous Petition was contested by the respondent by filing the counter, it is agreed by both the counsels that the parties are agreeable to get the O.P. transferred to the District Court, https://hcservices.ecourts.gov.in/hcservices/

Kancheepuram, which would be the convenient place for both the parties to appear.

5. Accordingly, with the consent of both the parties and their counsels the Transfer Civil Miscellaneous Petition is disposed of and F.C.O.P.No.216 of 2016, pending on the file of Family Court, Vellore shall stand withdrawn and transferred to the file of District Court, Kancheepuram.
